Welcome to ERStyles.com (“ERStyles,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, assessments, and related materials (the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Services.

1) Who can use ERStyles

  • You must be 13 years or older.
  • If you use the Services on behalf of another person or organization, you represent that you are authorized to accept these Terms for them.

2) What ERStyles is (and isn’t)

  • ERStyles provides educational and self-development content about emotional response styles.
  • We do not provide medical, psychological, or mental-health diagnosis, treatment, or therapy, and our materials are not a substitute for professional advice.
  • If you are in crisis or are considering harming yourself or others, stop using this site and call your local emergency number or a crisis hotline immediately.

3) Your use of the Services

We grant you a personal, limited, revocable, non-transferable license to access and use the Services for your own non-commercial purposes in line with these Terms. You agree not to:

  • copy, modify, distribute, sell, or lease our content or software;
  • scrape, harvest, or attempt to extract data (including by automated means) except as enabled by features we provide;
  • reverse engineer or circumvent security or access controls;
  • use the Services for unlawful, harmful, or deceptive purposes;
  • infringe others’ rights or upload unlawful, abusive, or infringing content;
  • use this site’s content as a replacement for therapy or medical advice.

We may suspend or terminate access if you violate these Terms or risk harm to the Services or others.

4) Accounts & comments

At this time, ERStyles does not offer user accounts or comments. If we enable them later, you’ll be responsible for keeping your login secure and for anything done under your account. We may remove or refuse content that breaks these Terms or the law.

5) Assessment results & educational materials

Assessment responses and results are for personal insight only. We do not guarantee accuracy or outcomes. Any workbooks or paid materials you purchase are licensed for your personal, non-commercial use. You may not share, post, or redistribute them without our written permission.

6) Purchases, payments, and refunds

  • Payments will be processed by Stripe or another third-party processor. We do not store full payment card numbers.
  • Prices may change from time to time. Taxes may apply.
  • Refunds: You may request a refund within 30 days of purchase.
  • Chargebacks that are abusive or fraudulent may result in account restrictions.

7) Intellectual property

All content on the Services – including text, graphics, logos, images, videos, and software – is owned by ERStyles or our licensors and protected by IP laws. “ERStyles” and related marks are our trademarks. Nothing here grants you any right or license except as expressly provided.

8) User content

If we enable uploads or comments: you keep ownership of your content, but you grant ERStyles a worldwide, non-exclusive, royalty-free license to host, store, display, and otherwise use it to operate and improve the Services. You represent you have all rights needed and your content won’t violate any rights or laws. We may remove content at our discretion.

9) Third-party services & links

We use reputable third-party services (e.g., hosting, analytics, email, payments, security, pop-ups, ecommerce). Their use may be subject to their own terms and privacy practices. Links to other sites don’t imply endorsement – we’re not responsible for those sites.

10) Privacy

Our Privacy Policy explains what we collect and how we use it. By using the Services, you consent to those practices.

11) No warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties and conditions, express or implied (including merchantability, fitness for a particular purpose, accuracy, and non-infringement). We do not warrant that the Services will be uninterrupted, secure, or error-free.

12) Limitation of liability

To the fullest extent permitted by law, ERStyles and our owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the greater of (a) the amount you paid to ERStyles in the 12 months before the claim, or (b) USD $50.

Some jurisdictions don’t allow certain disclaimers or limitations – if those laws apply to you, some of the above may not apply.

13) Indemnification

You agree to defend, indemnify, and hold harmless ERStyles and our affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or your violation of these Terms or any law.

14) DMCA / copyright complaints

If you believe content on ERStyles infringes your copyright, send us a notice:

Your notice must include the information required by 17 U.S.C. §512(c)(3). We may remove content and, if applicable, terminate repeat infringers.

15) Electronic communications

You consent to receiving notices and other communications from us electronically (e.g., on the site or via email if you’ve provided one). Keep your contact details current.

16) International use

We operate from Washington, United States. We don’t promise the Services are appropriate or available in every location. You’re responsible for compliance with local laws.

17) Governing law; disputes

These Terms are governed by the laws of Washington, United States, without regard to conflict-of-laws rules.

Arbitration & class-action:
Any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration in Washington, United States. You and ERStyles waive any right to a jury trial and to participate in a class action. You may opt out of arbitration by emailing [email protected] within 30 days of first use.

18) Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court or other tribunal of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms will continue in full force and effect.

19) Changes to these Terms

We may update these Terms to reflect changes to our Services or the law. When we do, we’ll revise the “Last updated” date above and, if changes are significant, provide additional notice. Continued use means you accept the updated Terms.
